Abstract
The error - the harmful act - and the contractual breach represent the basis for the establishment of civil liability in most legislations, and some legislators require the element of error for the establishment of tort liability, while the Jordanian legislature does not require it. In Jordanian Civil Code, the act is sufficient to be harmful to the wrongdoing act, as referred to under the article (256). From the Jordanian Civil Code "Any injury to others is necessary to do so even if it is not characterized by the guarantee of harm".
