Conditions and controls for publishing commentary on judicial rulings
1. The comment must be from a specialist from the legal or judicial men.
2. The suspension should deal with a judgment that has exhausted the means of appeal, in order to avoid the suspicion of influencing the appeal judges.
In other words, the judgment must be final and conclusive, and it should not be contested, as this case is considered a form of influencing judges and interfering in their work, which is legally abstained and criminally punishable.
3. The commentary should only discuss the legal principles on which the judgment is based, without the slightest interference with the body that issued it, or digging and searching into the secrets of intentions or hidden consciences.
4. Identify and present the legal problem raised by the judgment in question, quite clearly.
5. The researcher's commitment to the legal limits and restrictions to comment on judicial rulings, and not to turn his goal into a personal goal, which is to assault or insult the persons of judges, or to prejudice the prestige of the judiciary.
6. The objective of commenting on the referee should be to achieve one or more of the following objectives:
I. The judiciary has reversed its judicial direction to another new direction consistent with the principles of law, social reality, and the principles of justice.
II. Achieving a link between the theory of law and legal reality, based on full awareness of abstract legal science, and realistic application.
III. Upgrading the level of legal education in universities and judicial institutes.
IV. The development of legislation, through the adoption of the legal principles issued by the legislator by the various judicial authorities.
V. Developing the legal culture of university professors, judges, lawyers, and all those engaged in law.
VI. Reach the proper application of the legal rule on the factual elements, and determine the extent of convergence between the factual truth and the legal truth.
7. As well as the need to follow the scientific principles and rules followed for scientific research.
Important note for the researcher:
The journal uses word files submitted by the author for all online and print publications. Authors are required to prepare their papers using Microsoft Word, according to the template and then converted after approval for publication to PDF format.
Please ensure that when submitting the research, it is in final form ready for arbitration and has been accurately corrected.
As a summary, when preparing your paper, follow the guidelines listed with the template, and use the following checklist:
- There are no page numbers or headers and feet inside the sheet.
- Word is free of formatting errors (such as corrupted equations or missing or weak resolution numbers), because converting from word to PDF may result in formatting errors.
- The text is one spaced, not double-spaced.
- The Word file is editable and not password protected.
- All pages are vertical (horizontal pages must be rotated).
- Bibliographies are checked for accuracy. References can only be linked via CrossRef if they are correct and complete.
- Images are placed inside the text and are not grouped at the end of the document.
- A thorough proof reading is done to check the English level and ensure that the wording is clear and concise.
- Make sure your paper includes a summary.
